Terms of Service

1. Introduction

Welcome to Loacally (“we”, “us”, or “our”). Loacally is a local services marketplace operated by Loacally Ltd, a company registered in England and Wales. Our platform connects customers in London with trusted local tradespeople, including plumbers, electricians, handymen, decorators, and tilers.

By accessing or using our website at loacally.com (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Platform.

2. Definitions

  • “Customer” means any person who uses the Platform to search for, enquire about, or book services from a Provider.
  • “Provider” means any tradesperson or business that lists their services on the Platform.
  • “Visit” means a booking made through the Platform for a Provider to attend a Customer's property.
  • “Services” means the trade services offered by Providers through the Platform.

3. Eligibility

You must be at least 18 years of age to use the Platform. By creating an account, you represent and warrant that you are at least 18 years old and that all information you provide is accurate and complete.

4. Account Registration

To access certain features of the Platform, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Role of Loacally

Loacally acts as an intermediary platform that facilitates connections between Customers and Providers. We are not a party to any agreement between a Customer and a Provider for the provision of services. We do not employ, endorse, or guarantee any Provider listed on the Platform.

While we take reasonable steps to verify Provider information, the ultimate responsibility for assessing the suitability of a Provider rests with the Customer.

6. Visits and Payments

6.1 Booking a Visit

Customers may book visits with Providers through the Platform. Prices displayed are set by Providers and are shown for transparency. The price displayed at the time of booking is the price that applies.

6.2 Payment

All payments for services are made directly between the Customer and the Provider. Loacally does not process, hold, or facilitate payments between parties. Loacally is not responsible for any payment disputes between Customers and Providers.

6.3 Cancellations

Either party may cancel a visit through the Platform. We encourage cancellations to be made as early as possible to allow both parties to adjust their schedules. Repeated cancellations may result in account restrictions.

7. Provider Obligations

Providers agree to:

  • Provide accurate and up-to-date information about their services, qualifications, and pricing.
  • Hold all necessary licences, certifications, and insurance required to perform their advertised services.
  • Perform services to a professional standard in accordance with applicable UK regulations and industry best practices.
  • Respond to visit requests and customer communications in a timely manner.
  • Comply with all applicable laws, including health and safety regulations, consumer protection legislation, and tax obligations.

8. Customer Obligations

Customers agree to:

  • Provide accurate information when booking visits, including the correct address and description of the work required.
  • Be present or ensure access to the property at the agreed time of the visit.
  • Treat Providers with respect and provide a safe working environment.
  • Pay Providers promptly for completed work as agreed.

9. Reviews and Content

Users may leave reviews following a completed visit. Reviews must be honest, factual, and related to the service received. We reserve the right to remove reviews that are defamatory, abusive, fraudulent, or otherwise in breach of these Terms.

By submitting content (including reviews, images, and profile information), you grant Loacally a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce such content in connection with the operation of the Platform.

10. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Submit false, misleading, or fraudulent information, including fake reviews.
  • Interfere with, disrupt, or attempt to gain unauthorised access to the Platform or its systems.
  • Use automated tools, bots, or scrapers to access or collect data from the Platform.
  • Circumvent the Platform to arrange services directly with Providers found through Loacally, with the intent to avoid these Terms.

11. Intellectual Property

All intellectual property rights in the Platform, including its design, logos, text, graphics, and software, are owned by or licensed to Loacally Ltd. You may not reproduce, distribute, or create derivative works from any content on the Platform without our prior written consent.

12. Limitation of Liability

To the fullest extent permitted by law, Loacally shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses.

Loacally is not liable for the quality, safety, or legality of services provided by Providers, nor for the accuracy of Provider listings or the ability of Providers to perform services.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

13. Indemnification

You agree to indemnify and hold harmless Loacally Ltd, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform or your breach of these Terms.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. Sections of these Terms that by their nature should survive termination shall continue in effect.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the revised Terms on the Platform with an updated “Last updated” date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
